1. Introduction

The Digital Millennium Copyright Act (DMCA) is a significant piece of legislation that was enacted in the United States in 1998 to address the challenges posed by the internet and digital media to copyright law. The DMCA provides a framework for copyright owners to protect their works from unauthorized use and distribution online. This document outlines the procedures and policies in place on The Service regarding copyright infringement, the rights of copyright holders, and the responsibilities of users of The Platform.

Under the DMCA, copyright owners have the right to send a notice of infringement to service providers, such as The Platform, if they believe their copyrighted material has been used without authorization. The DMCA establishes a 'safe harbor' provision, which protects service providers from liability for infringing content uploaded by users, provided they comply with certain requirements. This includes promptly removing or disabling access to infringing material upon receiving a valid notice. The safe harbor provision encourages service providers to act responsibly while allowing them to avoid liability for the actions of their users.

Copyright holders have the exclusive right to reproduce, distribute, and display their works. If a copyright holder believes that their rights have been infringed upon, they may submit a DMCA takedown notice to The Service. This notice must include specific information, such as a description of the copyrighted work, the location of the infringing material, and the contact information of the copyright holder. Upon receiving a valid notice, The Platform will take appropriate action, which may include removing the infringing content or disabling access to it.

4. Counter-Notices

Users who believe that their content has been removed in error may submit a counter-notice to The Service. A counter-notice must include the user's name, address, and a statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification. Upon receiving a valid counter-notice, The Platform may restore the removed content unless the copyright holder files an action seeking a court order against the user.

5. User Responsibilities

Users of The Service are responsible for ensuring that the content they upload does not infringe upon the rights of any third party. By using The Platform, users agree to comply with all applicable laws and regulations regarding copyright and intellectual property. The Service reserves the right to terminate the accounts of users who repeatedly infringe upon the copyrights of others or who fail to comply with the DMCA.

6. Reporting Infringement

If you believe that your copyrighted work has been infringed on The Platform, please submit a DMCA notice to our designated agent. The notice should include the following information: a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; identification of the copyrighted work claimed to have been infringed; identification of the material that is claimed to be infringing and where it is located on The Service; your contact information, including your address, telephone number, and email address; a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
